Purchase Terms

These Purchase Terms explain how you buy a Rackaholic licence on rackaholic.net. They apply together with the Licence Agreement (EULA), which governs how you may use the software, and the Privacy Policy.

1. Who sells and who licenses

1.1. Rackaholic is made and licensed by Georgii Zvanbaia, individual entrepreneur registered in Georgia ("we", "us"). Contact: rackaholic.support@gmail.com.

1.2. Payments are taken by a payment platform, depending on your region:

• Creem (Armitage Labs OÜ, Estonia) for buyers outside the CIS. Creem is the merchant of record: it is the seller of record for your purchase, collects and pays the sales taxes that apply, and handles payments, refunds and chargebacks under its own buyer terms.
• Lava (lava.top, Lavalane LTD, Cyprus) for buyers in the CIS, through its payment partners, under its own buyer terms.

You accept the buyer terms of the platform you pay with on its checkout page.

2. What you buy

2.1. You buy a licence to use Rackaholic, not a copy of the software itself. The licence is perpetual and covers one computer, as set out in the EULA.

2.2. The licence includes:

• all modules of Rackaholic;
• the VST3 plug-in and the standalone application for Windows (64-bit);
• free updates within the version you bought;
• support by e-mail.

2.3. Suspension and termination. We may suspend or end a licence in the cases described in section 9 of the EULA — for example, when a key is shared or a licence was obtained by fraud. A licence that ends this way is not refunded, except where the law requires it.

2.4. Check before you buy. Rackaholic runs on Windows (64-bit) as a VST3 plug-in or as a standalone application. It is developed and tested in FL Studio. A macOS version is not available yet. Activation, and a licence check about once a day while you use it, need an internet connection; the software keeps working for up to 7 days without one. The licence service may be unavailable at times; see section 2 of the EULA.

3. Prices and regions

3.1. The price depends on the region where you live:

3.2. The CIS region covers: Armenia, Azerbaijan, Belarus, Kyrgyzstan, Kazakhstan, Moldova, Russia, Tajikistan, Turkmenistan, Uzbekistan. Choose the region where you live.

3.3. The final amount, including any taxes that apply, is shown on the checkout page before you pay. Your bank may charge its own fees for payments in a foreign currency.

3.4. We may change prices for future purchases. A change never affects a purchase you have already completed.

4. Placing an order

4.1. To buy, choose your region on rackaholic.net, press Buy and complete the payment on the checkout page.

4.2. The contract for your licence is formed when the payment platform confirms your payment.

4.3. Immediate supply. Rackaholic is digital content that we supply immediately after payment. On the checkout page you agree to the immediate supply and acknowledge that, as a result, you lose the statutory right of withdrawal where the law provides one (for example, in the European Union and the United Kingdom). See the Refund and Cancellation Policy.

4.4. Payment processing. Payments are received and processed by the payment platform, not by us. We do not see or store your card details, and we do not control:

• whether a payment is accepted, declined, held for review or delayed;
• the payment methods, currencies, exchange rates and fees;
• refunds and chargebacks that the platform handles under its own terms.

To the extent the law allows, we are not responsible for the actions, errors, delays or technical failures of the payment platform or of your bank.

4.5. When we issue the key. We issue the licence key only after the payment has been received and processed by the payment platform and we have its confirmation. A payment that is pending, held or under review is not yet a completed purchase.

4.6. Payment disputes. Disputes about a payment itself — a charge, a declined or delayed payment, a refund made by the platform, a chargeback, currency conversion or fees — are resolved directly with the payment platform under its buyer terms. The decision is the platform's. A request for a refund under our Refund and Cancellation Policy is sent to us; if we grant it, the refund is paid through the platform.

5. Delivery

We deliver your licence key and a link to the installer by e-mail. The Digital Delivery page explains how.

6. Refunds

Refunds are described in the Refund and Cancellation Policy. It does not limit the rights that the law of your country gives you.

7. Liability and law

7.1. Our liability is governed by section 8 of the EULA.

7.2. These terms are governed by the laws of Georgia, and disputes go to the courts of Tbilisi, Georgia. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence and any right to bring proceedings there.
