Privacy Policy
This policy explains what personal data we process when you buy, activate and use RACKAHOLIC, or contact us, and why. It also covers the rackaholic.net website and the licence service at api.rackaholic.net.
1. Who we are
The controller of your personal data is Georgii Zvanbaia, an individual entrepreneur registered in Georgia. E-mail: rackaholic.support@gmail.com.
Write to that address with any question about this policy or your data.
2. What we collect, why, and on what legal basis
2.1 When you buy a licence
- Data: your name, e-mail address, country, the product and price, the order number and date, and the licence key we issue to you.
-
Why:
- to sell you the licence and deliver the licence key;
- to provide support and handle refunds;
- to keep the accounting records that tax law requires.
-
Legal basis:
- performance of our contract with you (GDPR Art. 6(1)(b));
- compliance with legal obligations (Art. 6(1)(c)).
-
Payments. Your payment details go directly to the payment platform. We never see or store your card number.
- Creem (Armitage Labs OÜ, Estonia) processes purchases outside the CIS. Creem is the merchant of record: it is the seller of record for your purchase, collects and pays sales taxes, and handles payments, refunds and chargebacks. For the data it collects for these purposes Creem is an independent controller, and its own privacy policy applies. Creem passes us your name, e-mail address, country and order details.
- Lava (lava.top, Lavalane LTD, Cyprus) processes purchases in the CIS countries, through its payment partners. Lava passes us your e-mail address and order details. Lava's own privacy policy applies to the data it collects.
2.2 When the software activates and checks your licence
The software needs to know that a licence key is used on no more computers than it allows.
What we store. When you activate, and about once a day while you use the software, it contacts our licence server and we store:
- your licence key, and the name and e-mail address the licence was issued to;
- a computer code. This is a hash calculated on your computer from its hardware data. It identifies the computer to our server, but contains no name, files or other content from it;
- the version of the software;
- the time of the first and the latest activation or check on that computer;
- the IP address the request came from. We use it to slow down repeated wrong key attempts and to keep a security and support log of activations and checks.
Why:
- to activate your licence and confirm it;
- to let you move it to another computer;
- to protect the service against key sharing and attacks;
- to answer your support requests.
Legal basis:
- performance of our contract with you (Art. 6(1)(b));
- our legitimate interest in preventing fraud and misuse of the service (Art. 6(1)(f)).
2.3 When you contact us
- Data: your e-mail address, your message and anything you choose to send us, such as screenshots.
- Why: to answer you.
-
Legal basis:
- performance of our contract with you (Art. 6(1)(b)), or
- our legitimate interest in answering enquiries (Art. 6(1)(f)).
2.4 When you visit the website or download the software
- Data: our hosting provider processes technical data that every web request carries: your IP address, browser type, the requested page or file, and the time.
- Why: to deliver the website and downloads and to keep them secure.
- Legal basis: our legitimate interest (Art. 6(1)(f)).
- Cookies and local storage. The website does not use cookies, analytics or advertising tools. It remembers your language and region choice in your browser's local storage; that stays on your device and is never sent to us.
-
Your region. To show the price for your region, the page asks our hosting provider for the country of your connection (Cloudflare's
/cdn-cgi/trace). The answer is used only in your browser to pick the price; we do not receive or store it.
3. What the software does not collect
RACKAHOLIC does not send us:
- your audio;
- your projects;
- your presets or settings;
- usage statistics or crash reports.
The ONNX Runtime library inside the software can send telemetry, and that telemetry is switched off.
These files stay only on your computer:
-
the licence confirmation file (
%APPDATA%\RACKAHOLIC); -
your presets (
Documents\RACKAHOLIC).
4. Who receives your data
We do not sell your personal data, and we do not share it for advertising. We use these service providers (processors), who process data only on our instructions:
- Cloudflare, Inc. (USA) runs the licence server, the database behind it, the file downloads, and the website's hosting and network.
- Creem (Armitage Labs OÜ, Estonia) and Lava (Lavalane LTD, Cyprus) handle payments; see 2.1.
- Google LLC (USA) provides our e-mail service (Gmail).
We may also disclose data where the law requires it, or to establish or defend legal claims.
5. International transfers
Some of our providers process data outside Georgia and the European Economic Area, in particular in the United States. Where we transfer data from the EEA, the UK or Switzerland, we rely on one of:
- the EU–US Data Privacy Framework, where the provider is certified;
- the European Commission's Standard Contractual Clauses;
- the equivalent safeguards for the UK and Switzerland.
6. How long we keep data
| Data | How long we keep it |
|---|---|
| Licence and purchase records: name, e-mail, licence key, order | While your licence exists, and afterwards for as long as tax and accounting law requires (6 years) |
| Computer records of a licence: computer code, version, first and last seen | While the licence exists. Deleted on request when the computer is released |
| Security and support log of activations and checks, including IP addresses | 24 months |
| Records of failed key attempts per IP address | 90 days |
| Support e-mails | 3 years after the last message |
7. Your rights
Depending on where you live, you have the right to:
- access your personal data;
- correct it;
- have it erased;
- restrict its processing;
- object to processing based on our legitimate interests;
- receive your data in a portable format;
- withdraw any consent you gave.
To use these rights, write to rackaholic.support@gmail.com. We answer within one month.
If your licence data is erased, we can no longer confirm your licence, so the software will stop working on your computers.
You also have the right to complain to a data protection authority:
- in Georgia, the Personal Data Protection Service of Georgia;
- in the EU, EEA or UK, the authority of the country where you live or work.
8. Security
- All communication with the licence server and the website uses encrypted connections (HTTPS).
- Licence confirmations are digitally signed.
- Access to the licence database is restricted to us.
9. Children
RACKAHOLIC is not directed at children under 16, and we do not knowingly collect their data.
10. Changes to this policy
We may update this policy. We will publish the new version here with its effective date. If the changes are significant, we will also tell licence holders by e-mail.
